The suspect, referred to here as S. M., was finally granted freedom by the Court of Appeal despite being charged with the crime and sentenced with execution on April 23, 2012 by the criminal court.

Shokhan, 21 and Shadi, 18 were kidnapped from their home in Chamchamal in mysterious circumstances on the evening of January 2, 2011, and found dead one day later, for which S.M. was charged with the crime.

S. M., who was previously a member of the Kurdistan Democratic Party’s security forces of Kirkuk, held a press conference today, June 13 and said “When I was first charged with the crime two and half years ago, I was transferred to Chamchamal, and there I was tortured for eight days when I was held in custody.”

“I was subject to verbal and physical abuse, including hanging and electrocution,” he stated.

“None of the prisoners were tortured as I was. I call for the president, the Ministry of Interior and security forces to investigate my case.” he told the reporters.

Shakhawan Abdullah, legal colonel of the Democratic Party’s security forces of Kirkuk said “The Chamchamal security forces held our member for eight days in custody and tortured him to an extent that no one has ever been tortured like that in Kurdistan.”

“The security forces had tortured him even after his transfer to the police, and fortunately the Court of Appeal finally issued his innocence and abolished his sentence.” he added.

The lawyers of the two murdered sisters have previously stated that the court has very reliable evidence that S.M. is the perpetrator, saying “The weapon used in the killing was in S.M.’s possession when he was arrested.”

If he has been tortured he could have told anything to the police, even if he is innocent. In another way, if he is a serial-killer, they have released him without control.

Kurds have to reform seriously their methods of investigations : torturing in custody does not help to discover the truth and spoils all the judiciary process.
