German ZDF broadcaster to defend popular comic facing probe over Erdogan satire

Germany’s public broadcaster ZDF said it will offer comedian Jan Boehmermann full legal protection after the German government gave the green light to his potential prosecution for mocking the Turkish president.

ZDF director general Thomas Bellut told Der Spiegel magazine on Saturday that the company will defend its top comic Jan Boehmermann in all courts as he currently faces defamation charges filed against him upon request of Turkish President Recep Tayyip Erdogan.

Two weeks ago, Boehmermann recited a satirical poem on television suggesting that Erdogan enjoys watching child pornography, has inclination to zoophilia and hits girls.

"We will accompany him through to the highest courts," Bellut said. He added that the show pushed moral boundaries, which explains his decision to remove the poem from the ZDF website. However, an editor who approved the broadcast will face no disciplinary measures.

"It wasn't easy for me, but I still think it was the least bad decision that I could take," Bellut said.

On Friday, Chancellor Angela Merkel's government authorized a criminal inquiry against Boehmermann. Merkel said on Friday that the government’s decision was "neither a prejudgment of the person affected nor a decision about the limits of freedom of art, the press and opinion," according to Spiegel.

The charges against the comedian are being brought about upon the basis of a controversial item in the criminal code, Article 103, relating to insults against foreign heads of state. However, it leaves it up the government to decide whether to authorize legal proceedings in such cases.

The article dates back to the times of the German Empire as the penal code was drafted in 1871, and at that time it applied to monarchs. Colloquially known as the "Shah Law" among German lawyers – the Shah of Iran resorted to the article and won a case against a Cologne newspaper in 1964 – it has been rarely used over the recent years.

The Article 103 says: “Whosoever insults a foreign head of state, or, with respect to his position, a member of a foreign government … shall be liable to imprisonment not exceeding three years or a fine.”

Before announcing the government’s approval of charges against Boehmermann, Chancellor Merkel said that the poem had been "deliberately offensive." Her remarks led to accusations in Germany that she was not standing up for freedom of speech.

Justice Minister Heiko Maas, also an SPD member, said the decision on whether or not Boehmermann's poem was satire or defamation is entirely up to the courts. Later, he tweeted: “We want to abolish Article 103. Special provisions for insulting foreign heads of state have fallen behind the times.”

President Erdogan has drawn widespread criticism in Turkey and beyond for persecuting political opponents. This has included a crackdown on journalists and freedom of speech. Many also accuse him of authoritarian methods which suppress legitimate dissent and promote an Islamist agenda.

In Germany, some worry that Chancellor Merkel compromises on human rights and civil liberties in order to secure Turkey’s cooperation to stem the influx of refugees into the EU.

Jan Boehmermann is a well-know and well-loved comedian

Making fun of people and events in videos is something he regularly does

Erdogan should have laughed it off instead he has just proved himself to be a:

Sad-sack, goofy, cowardly and broken-down

Erdogan is the President.

His thievery stinks like bad pizza,

Against which even a pig’s fart smells nice. =)) :)) =))

Boehmermann could have added that Erdogan used MILLIONS of Turkish tax-payers money, to build himself a 100 roomed fortress illegally on dedicated parkland X(

German MP recites notorious anti-Erdogan poem in front of Bundestag

Germany’s parliament was shocked when one MP read aloud a notorious poem about Turkey’s president which sparked an international free speech row last month. His performance was aired on national TV. He said the aim had been to show how “awful” it was.

The poem about Turkish President Recep Tayyip Erdogan gained an audience in the Bundestag when Detlef Seif, a member of Chancellor Angela Merkel’s CDU party recited the entire text standing at the pulpit.

“Unbelievable,” the audience gasped in awe when Seit began to recite the text.

It turns out, Detlef Seit meant no harm to the Turkish leader. Instead, according to Seit, he wanted to illustrate how awful the text was, claiming that he had been absolutely disgusted by it.

“I didn’t want to do this, but I read this to you so that one knows what was actually said here,” Seif said according to German media. “A person’s honor is clearly infringed upon here.”

Legislators were taken aback and lashed out at the MP.

Renate Kunast, MP for the Green Party, said she was “very embarrassed” for parliament and wondered what had got into Seit to make him act in such a way. Christian Flisek of the Social Democrats (SPD) said “he could have saved the quoting of the poem for himself.”

House Speaker Edelgard Bulmahn said that when speaking politicians should remember at all times they are in the German parliament and that “even with quotations one should not forget about it,” German media reported.

Luckily for Seif, as an MP he is “immune” to prosecution should Erdogan choose to initiate legal action against him. But the author of the poem, Jan Bohmermann, whose prosecution was recently approved by Chancellor Angela Merkel, insists that the same standards should apply to the politician.

“I hereby request the lifting of parliamentary immunity of CDU MP Detlef Seif for prosecution under paragraph 103 of the penal code,” Bohmermann wrote on Twitter.

Seit complained to Bild that “the reaction of Jan Bohmermann is a bit too thin-skinned.”

“From conversations with many citizens I know that the abusive poem written by Bohmermann has been known only in parts. However, in order to be able to form an opinion as to whether such formulations can be called artistic freedom, you have to know the whole poem. I did not defend Mr. Erdogan, but only contributed to the discussion,” Seit told Bild.

Meanwhile Erdogan’s lawyer Ralf Hoecker said that there were no grounds for the Turkish President to file a complaint, since Seit’s speech was a “perfectly legal” and “good example” of how to voice bad content without insulting anyone.

In March, German comedian Jan Bohmermann recited the poem, in which he stated that the Turkish President had an inclination to zoophilia and enjoyed watching child pornography. In response, Erdogan requested that the German government prosecute the comic. Chancellor Angela Merkel complied with the request and greenlighted the proceedings for which she has received strong condemnation from the general public who were wary that she had been compromising freedom of speech.

There is nothing about Kurds, good or bad. But it extremely insults ordogun. The only word I understand is 'sherefsiz', which means 'pimp' or without honour
